1. Who you are contracting with

You are contracting with North Designer, a website design studio serving salons, restaurants, and other small businesses. You can reach us at hello@northdesigner.com.

2. Acceptance of these terms

By continuing to use this website or by purchasing any service from us, you accept these terms. If you do not agree with them, please do not use the site or purchase our services. If you are entering this agreement on behalf of a business, you confirm you have the authority to bind that business. If you are contracting as an individual, you confirm you are of legal age in your jurisdiction.

3. Our services

We design and build websites for small businesses. Depending on the package purchased, this may include a single-page site, a multi-page site, and an optional AI assistant integrated into your website. The exact scope of any project is agreed between us in writing before work begins, based on the requirements you provide.

You agree to provide accurate information about your business and to keep it up to date. Delays in providing content, feedback, or approvals may extend project timelines.

4. Acceptable use

You must not misuse this website or the services we provide. In particular, you must not:

• use them for any unlawful purpose or in breach of any applicable law;
• engage in fraud, spam, or deceptive activity;
• infringe the intellectual property or other rights of any third party;
• interfere with the security or integrity of the site, including introducing malware, probing for vulnerabilities, or scraping content by automated means;
• use any AI assistant we build for you to generate unlawful, hateful, deceptive, or infringing content.

5. Intellectual property

North Designer retains ownership of its own tools, templates, code libraries, processes, and branding. On full payment of the agreed project fee, you receive ownership of, or a perpetual licence to use, the final delivered website for your business. Content you supply (text, images, logos, menus) remains yours, and you grant us a limited licence to host and process it solely to deliver the project. You confirm you have the rights to any content you provide to us.

6. Service level

We take care to deliver a high-quality result, but we do not guarantee that this website or any service will be uninterrupted, error-free, or free of defects, and we do not guarantee any particular commercial outcome such as rankings, traffic, or sales.

7. Payment, billing, and taxes

Projects are confirmed with a deposit, which is credited toward your final invoice. Prices shown on this site are in the currency indicated at checkout and may be subject to sales tax or VAT depending on your location.

Payment, billing, currency, tax, cancellation, and refund mechanics are handled by our reseller. Please see the Paddle Buyer Terms and our Refund Policy.

8. Order process and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

9. Suspension and termination

We may suspend or terminate your access to our services, or stop work on a project, if there is a material breach of these terms, non-payment of amounts due, a security or fraud risk, or repeated or serious violations of our acceptable use rules. Where a project is terminated, we will hand over any work already paid for and confirm what happens to your content.

10. Warranties and liability

To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Our total aggregate liability arising out of or in connection with our services is limited to the fees you paid to us in the twelve months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these terms excludes liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded by law.

11. Indemnity

You agree to indemnify us against claims arising from content you supply, your unlawful use of our services, or your breach of these terms.

12. General

These terms are governed by the laws of the Province of Ontario, Canada, and the courts of that province have jurisdiction over any dispute. You may not assign your rights under these terms without our consent; we may assign ours in connection with a merger or sale of our business. Neither party is liable for delays caused by events beyond its reasonable control. We may update these terms from time to time and will change the "last updated" date above.
